Terms & Conditions
1. Definitions & Scope

Client refers to any individual or entity commissioning services from Elite Spray Pave.

Services include—but are not limited to—spray paving, concrete resurfacing, epoxy coatings, sealing, preparation, and related works.

These Terms & Conditions apply to all quotes, work orders, and agreements between Elite Spray Pave and the Client unless explicitly amended in writing.
2. Quotations & Acceptance

Written quotes are valid for a specified time (e.g., 30 days). Prices may be adjusted after expiry.

Acceptance of a quote by email, signed document, or deposit signifies agreement to these Terms & Conditions.
3. Payment Terms
-
A deposit (e.g., 25–50% of the total cost) is required to secure the booking.

Credit card payment occur 1.5%
-
Balance payment is due upon job completion or according to any agreed payment schedule.

Late payments may incur a surcharge (e.g. 2–3% per month) and accrued interest.
4. Site Access & Preparation
-
The Client must ensure safe, unrestricted access, including power, water, and clearance of furniture or obstacles.

Delays caused by inadequate access may lead to additional fees or rescheduling.
5. Work Schedule & Delays
-
Estimated start and completion dates are guidelines and may be impacted by weather, material availability, or site conditions.

Elite Spray Pave will notify the Client of any expected delays.
6. Variations & Additional Work
-
Any additional work beyond the original scope must be documented and quoted separately.

Such variations may affect timing and cost.
7. Finishing & Quality
-
Spray-applied coatings may result in slight color/texture variations due to hand application and substrate differences.

Elite Spray Pave strives for high-quality outcomes but cannot guarantee identical finishes across different areas or repairs.
8. Guarantees & Liability
-
A limited warranty (e.g., 7 years for workmanship and preparation) may apply, subject to proper maintenance.

Conditions: No unauthorised third-party interventions post-completion; Client must follow recommended maintenance, and report issues promptly.

Warranty excludes damage due to substrate failure, chemicals, fauna, flooding, or acts of nature.
9. Access & Deliverables
The Client must ensure safe transport, removal, or storage for materials and equipment if installation is delayed or unavailable.
10. Termination & Liability

The Client may cancel with specified notice (e.g., 48 hours), potentially forfeiting the deposit.

Elite Spray Pave may terminate the agreement if terms are breached or payments are overdue.

Liability is limited to re-performing the work or refunding the relevant portion of the fee, excluding indirect or consequential losses.
11. Insurance

Elite Spray Pave maintains necessary public liability insurance.

Clients are responsible for any damage to their own property not caused by Elite Spray Pave.
12. Confidentiality & Intellectual Property

Designs, plans, and proprietary methods remain the intellectual property of Elite Spray Pave, unless otherwise agreed.

The Client may not reproduce or share designs outside the project.
Elite Spray Pave is not liable for delays or failure where caused by events outside its control (e.g., extreme weather, supply issues, government restrictions).
13. Force Majeure

Disputes should be communicated in writing; both parties agree to attempt resolution in good faith.

These Terms are governed by the laws of New South Wales, Australia.
15. Modifications
-
Elite Spray Pave reserves the right to modify these Terms at its discretion. The latest version will apply to future agreements.
